Operational Terms & Conditions

The following Operational Terms and Conditions (“Terms”) govern the relationship between Secure Transit, Inc. (“Carrier”) and brokers, shippers, and 3PLs engaging Secure Transit, Inc.for transportation services. By using our services, you agree to these Terms, which are binding both during and after any freight transportation provided by Secure Transit, Inc.


1. Tracking Requirements

Secure Transit, Inc. exclusively uses Trucker Tools and MacroPoint for freight tracking purposes. No other third-party tracking platforms or systems are authorized. All brokers, shippers, and related parties must utilize these approved platforms for real-time shipment
tracking.

Applicable Law:

  • The Federal Motor Carrier Safety Regulations (FMCSRs) (49 CFR § 390.5 et seq.) ensure the use of compliant tracking systems to enhance safety and operational transparency. Secure Transit, Inc. reserves the right to restrict tracking to authorized platforms to prevent unauthorized access.

2. Data Protection and Information Sharing

Secure Transit, Inc. is committed to safeguarding sensitive and personal information.The sharing of sensitive documents or information, including but not limited to:

  • Customized photographs
  • Driver’s licenses (DL)
  • Vehicle cab cards / equipment registration
  • Truck VIN numbers

with any external company is strictly prohibited. No external Electronic Logging Device (ELD)
connections to third-party systems are allowed.

Applicable Law:

  • The California Consumer Privacy Act (CCPA) (Cal. Civ. Code § 1798.100 et seq.) mandates the protection of personal data, including driver information. Secure Transit, Inc. ensures compliance with privacy laws and prohibits unauthorized sharing of sensitive information.
  • The Driver’s Privacy Protection Act (DPPA) (18 U.S.C. § 2721 et seq.) prohibits the disclosure of personal information obtained from motor vehicle records without consent. Secure Transit, Inc. strictly adheres to this regulation.

3. Driver Communication and Safety Policy

For the safety of our drivers and the integrity of our operations, the following policies must be followed:

  • Prohibition on Cell Phone Use: Secure Transit, Inc. drivers are prohibited from using mobile devices while on duty. This policy ensures compliance with federal and state regulations regarding distracted driving.
  • Direct Contact Approval: Any direct communication with Secure Transit, Inc. drivers must be pre-approved by the company. Brokers, shippers, and 3PLs are not permitted to contact drivers directly without such approval.


Applicable Law:

  • FMCSA Cell Phone Regulation (49 CFR § 392.82) prohibits commercial motor vehicle (CMV) drivers from using mobile devices while driving, ensuring driver safety.
  • California Vehicle Code § 23123.5 prohibits the use of handheld wireless devices while driving unless hands-free, in alignment with state safety requirements.

4. Compliance and Enforcement

All brokers, shippers, and 3PLs must comply with Secure Transit, Inc.’s Terms and Conditions during and after freight transportation. Any violation or breach of these terms may result in termination of services, refusal to continue providing transportation, or legal action. Secure Transit, Inc. reserves the right to take necessary steps to enforce compliance and protect the integrity of its operations.

Applicable Law:

  • The California Business and Professions Code § 17200 prohibits unlawful, unfair, or fraudulent business practices. Non-compliance with these Terms may be considered a violation.
  • The Federal Arbitration Act (FAA) (9 U.S.C. §§ 1-16) supports the enforcement of arbitration agreements to resolve disputes related to these Terms.

5. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.


6. Entire Agreement

These Terms and Conditions represent the entire operational agreement between Secure Transit, Inc. and brokers, shippers, and third parties engaging its services. These Terms supersede any prior agreements or understandings, whether written or verbal, and may only be modified in writing and with the approval of both parties.


7. Accessorial Charges

  • Detention: $50 per hour (after 2 hours free)
  • TONU (Truck Ordered Not Used): $250
  • Layover: $200 per day
  • Extra Stop: $100 per additional stop
  • Tailgate/Driver Assist: $200

By engaging Secure Transit, Inc. for transportation services, you agree to comply with the terms outlined above. Any failure to adhere to these policies may result in termination of services and/or legal consequences.
